New Delhi, Aug 21 (PTI) No civil society can approve the use of recovery agents by service providers to collect dues from their customers, the Delhi Consumer Commission has said.
"We have been deprecating the practice of service providers employing recovery agents to recover the dues even if these are legal dues as no civilised society can brook such a method, particularly, in a democratic set up," Commission President Justice J D Kapoor said.
The Commission held that the companies cannot enjoy powers of courts by resorting to such tactics as "every right of service provider or consumer has to be claimed or settled through due process of law." The Commission's observations came on an appeal filed by Tata Tele Services Ltd against an order of the district forum, asking it to pay Rs 30,000 as compensation to Sameer Nandwani, a practising advocate, for deficiency in service.
It partly allowed the appeal by reducing the compensation to 20,000.
Nandwani, who had purchased a post-paid CDMA mobile connection from the service provider, alleged that the company even after surrendering the phone not only kept on raising the bill but extended threats through its recovery agents.
HC criticises 'strong arm' tactics of banks
Kochi, Aug 14 (PTI) The Kerala High Court today came down on the 'strong arm' tactics adopted by some new generation banks, to recover loan amounts from customers and held that they should respect the law of the land.
Police should take effective steps to 'nip in the bud' attempts by such banks to recover loan amounts, a division bench headed by Justice K Balakrishnan Nair said while disposing of a petition filed by one Sabu of Thiruvananthapuram complaining harassment by goondas allegedly engaged by the private HDFC bank.
The petitioner submitted that he had purchased a car availing loan from the bank and following default in payment, the bank authorities threatened the petitioner and his wife by sending 'goondas'. Despite complaints to the police, no action was taken, he submitted.
The bench held that the bank had no right to employ strong arm methods to recover the vehicle. The bank has to respect the law of the land and take recourse to remedies available under law.
